Well i would think that if you are jaywalking a place where there is low visibility for the driver thens its your fault
but if the driver can see you from a long ways away then i would proclaim that it is a fault on both cases

I say it's pretty much common sense. The pedestrian does have the right away unless you do something stupid like dart in front of traffic without looking.

hmm...i think this is one where you have to look it up in the actual law book
