It's from Wal Mart. It's likely someone bought the game and replaced it with a pirated UMD. Wal Mart is piss poor in checking on returns.

I bet that little kid was scared to death when he saw somethings he didn't know about. I bet he's gonna' be asking mommy alot of questions about females.

I'm not an expert on legal advice, but I would wager they could possibly be sued by the receiver for not adequately checking the return. Because that's who's fault this is going to be - no one past the Wal Mart level up the ladder could possibly be concerned with this. These sorts of things happen quite often with Wal Mart and people using the switcheroo, due to uneducated workers there and a combination of "not give a shit" company policy - or also known as to make the whole process easier and just let the bad eggs spoil.
However, this sort of event is a much larger issue than buying a game and getting a different game, blank disc, or empty case, etc since it contained what could be conceived as "offensive" material. This is the big problem with the case, however I would not lay the blame on Wal MArt particularly. I would blame the bad taste of society and Wal Mart as a secondary. Sure, they didn't adequately check, but people should have ethics. If they are able to track this return (they often require ID for this now and they record it in a database, DL number), it is entirely plausible (assuming that my guesses concerning this situation are true) that they could have a lawsuit against this man for several charges (essentially "theft" and other criminal mischief).
Personally, I do not feel Wal Mart is legally viable, but in our country the way the legal system is designed is for big money to be made from bullshit lawsuits. Sue sue sue. The american way.
I'm unsure of how easy it is to copy the proprietary hardware UMD, but I assume the technology exists well enough. There's no way this title came like this from the factory/distribution center.
That's my 2 cents.
